1. Acceptance of Terms

By accessing or using Aethyro ("the Software," "the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms apply to all users including individuals, businesses, and organizations.

2. Description of Service

Aethyro Cloud is a browser-based AI assistant powered by Anthropic's Claude Opus 5 model. The Service includes:

• Conversational AI chat via Claude Opus 5, billed per usage in credits
• Persistent conversation history stored securely in your account
• Credit-based billing — purchase credit packs, use them at your pace, credits never expire
• A free trial of 200 credits on account creation

Aethyro Cloud is designed to assist with productivity tasks including writing, coding, research, and analysis. It is not a provider of legal, medical, financial, accounting, or any other licensed professional services.

3. Not Professional Advice

All content, outputs, suggestions, documents, and analysis generated by Aethyro are for informational and productivity purposes only. Nothing produced by the Service constitutes:

• Legal advice or representation
• Medical or clinical advice, diagnosis, or treatment
• Financial, tax, or accounting advice
• Any other form of licensed professional advice

All AI-generated outputs must be reviewed and verified by a qualified licensed professional before use in any professional context. You are solely responsible for any decisions made based on AI-generated content.

4. Data Privacy & Cloud Processing

Aethyro Cloud is a cloud-hosted service. Your messages are transmitted to our backend and processed via Anthropic's Claude API to generate responses. Conversations are stored in our database so you can access your history. We do not:

• Sell your data to third parties
• Use your conversation data to train AI models
• Share your data with any party other than those necessary to operate the Service (Anthropic for AI inference, Supabase for data storage, Stripe for payments)

You are responsible for ensuring your use of the Service complies with applicable data protection laws relevant to your industry and jurisdiction. If your use case requires strict data residency or prohibits third-party AI processing, do not use the Service without contacting us first.

5. Acceptable Use

You agree not to use Aethyro to:

• Generate content that is unlawful, harmful, or fraudulent
• Impersonate any person, business, or licensed professional
• Create or distribute malware or harmful code
• Violate any applicable law or regulation
• Attempt to reverse-engineer or extract proprietary components

6. Credits & Billing

Aethyro Cloud uses a prepaid credit system. You purchase credit packs via Stripe and credits are consumed as you use the Service. Credits never expire and are non-transferable between accounts.

New accounts receive 200 free credits on signup at no charge. Credit purchases are non-refundable except where required by law. If you believe a charge was made in error, contact us within 30 days.

Credit prices and pack sizes may change; existing purchased credits are unaffected by price changes. We are not responsible for unused credits if you choose to stop using the Service.

7. Intellectual Property

Aethyro and its underlying technology, branding, and software remain the intellectual property of Aethyro. You retain full ownership of any content or data you input into the Service. AI-generated outputs produced from your inputs are yours to use subject to these Terms.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI OUTPUTS WILL BE ACCURATE OR COMPLETE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AETHYRO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE THREE MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless Aethyro, its owners, and affiliates from any claims, damages, or expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

11. Changes to Terms

We may update these Terms at any time. We will notify you of material changes by posting the updated Terms on this page with a revised date. Continued use of the Service after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved through binding arbitration rather than in court, except where prohibited by law.
